1) Introduction

This Privacy Policy explains how V-Mark (“we”, “us”, “our”) collects, uses, discloses, and protects personal information when you use our mobile application (the “App”).

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and British Columbia’s Personal Information Protection Act (PIPA), including their fair-information principles (accountability, identifying purposes, consent, limiting collection/use/retention, accuracy, safeguards, openness, individual access, and challenging compliance). 

Where required by other laws (e.g., GDPR/CCPA) for users located in those jurisdictions, we will honor any additional mandatory rights. Our primary compliance framework, however, is Canadian federal law and B.C. law.

2) Permissions & Purposes (App Permissions Use Statement)

We request only the minimum permissions necessary and explain them at or before collection. You may revoke any permission in your device settings at any time; certain features may become unavailable if you do so. This aligns with PIPEDA/PIPA principles on consent, identifying purposes, and limiting collection. 

· Photo Library / Media (Optional)
Purpose: Let you upload a profile image, attach photos to support tickets, or share device screenshots.
Data handled: Selected media only; we do not scan or collect your entire gallery.
Revocation: OS privacy settings.

· Push Notifications (Optional)
Purpose: Send alerts about sensor status (e.g., temperature thresholds), account/security notices, and—only with your consent—marketing updates.
Compliance note: Marketing notifications are treated as “commercial electronic messages”; we obtain express consent, clearly identify the sender, and provide an easy unsubscribe per CASL. You can turn off marketing notifications in-App and via OS settings at any time.

· Location – Approximate/Precise (Optional)
Purpose: Improve device pairing and show the site of installed sensors; enable geofenced alerts you opt into.
Data handled: Current location when you use features that need it; we do not track movement in the background unless you explicitly enable a geofenced feature.
Revocation: OS privacy settings.

· Bluetooth (Optional)
Purpose: Pair with nearby V-Mark hardware sensors and read temperature data.
Data handled: Bluetooth identifiers needed for pairing; no audio content.
Revocation: OS Bluetooth permissions.

· Camera (Optional)
Purpose: Scan device QR codes during setup; capture a profile or site photo you choose to upload.
Data handled: Images you capture and confirm.
Revocation: OS camera permission.

· Network / Internet Access (Required)
Purpose: Sync sensor readings, account data, and deliver notifications.
Data handled: Device IP, basic telemetry needed for connectivity.

· Background App Refresh (Optional)
Purpose: Fetch pending alerts so you receive timely notifications you opted into.
Revocation: OS background refresh setting.

· Crash Logs & Analytics (Optional where allowed)
Purpose: Improve reliability and performance; measure feature usage in aggregate.
Data handled: App version, device model/OS, anonymized or de-identified usage events (no content from your albums, messages, or files).
Choice: You can disable analytics in Settings. We implement safeguards and data minimization per PIPEDA/PIPA guidance for mobile apps.  


We do not access contacts, SMS, call logs, or microphone. If future features require additional permissions, we will request new consent and update this Policy before activation.


3) Information We Collect

· Account & Profile: Name, email, phone (optional), organization, role.

· Device & App Data: Device model, OS version, App version, IP address, language, and settings; basic event logs for security and troubleshooting.

· Sensor & Operational Data: Pairing identifiers, device names you assign, temperature readings and timestamps, alert configurations.

· Location (optional): As described above.

· Communications: Support requests, emails, and in-App messages.


We identify purposes, limit collection to what is necessary, and use reasonable safeguards appropriate to sensitivity. 


4) How We Use Personal Information

· Provide, maintain, and improve the App and devices.

· Configure, monitor, and alert on temperature thresholds.

· Authenticate users; prevent fraud and abuse.

· Communicate service, security, and transactional notices.

· With your separate consent, send marketing communications (and only in compliance with CASL; you can withdraw consent/unsubscribe at any time).  


5) CASL Compliance (Marketing Messages)

For any commercial electronic messages (including marketing emails, SMS, or push notifications), we obtain express consent, identify ourselves, and include a working unsubscribe mechanism. You can also email Info@-mark.com with “Unsubscribe” in the subject. 


6) Legal Bases & Consent

We rely on your knowledge and consent for collection, use, and disclosure unless an exception applies (e.g., security incident, legal requirement). You may withdraw consent, subject to legal/contractual limits and reasonable notice; we will explain any consequences of withdrawal (e.g., feature loss). 


7) Retention

We keep personal information only as long as needed for the purposes described or as required by law; then we securely delete or de-identify it per industry practices. 


8) Sharing & Service Providers (Including Cross-Border Processing)

We may use vetted third-party processors (cloud hosting, analytics, customer support). When we transfer personal information for processing, we remain responsible under PIPEDA/PIPA for safeguarding it and ensuring processors provide a comparable level of protection; cross-border transfers are permitted with appropriate contractual and organizational safeguards and transparency. 


9) Your Rights (Access, Correction, Choices)

Subject to limited exceptions, you may:

· Access the personal information we hold about you;

· Request correction of inaccurate/incomplete information;

· Withdraw consent and opt-out of marketing;

· Challenge our compliance with a privacy officer.


How to exercise your rights or make a complaint to us: Info@-mark.com. We will respond within timelines set by applicable law. Under PIPEDA (Principle 9) and B.C. PIPA (Part 7), you have access and correction rights. 

If we cannot resolve your concern, you may contact the Office of the Information and Privacy Commissioner for British Columbia (OIPC BC) or the Office of the Privacy Commissioner of Canada (OPC). 


10) Children’s Privacy

The App is not directed to children under 13. We do not knowingly collect their personal information. If you believe a child provided personal information, contact Info@-mark.comand we will delete it.


11) Security

We use administrative, technical, and physical safeguards proportionate to the sensitivity of data (e.g., encryption in transit, access controls, logging). However, no method of electronic transmission or storage is perfectly secure. 


12) Third-Party Services & Links

The App may link to third-party sites or integrate SDKs (e.g., analytics, payments, social sign-in). Their privacy practices apply when you use them; we encourage you to review their policies.


13) International Users

If you are outside Canada, your information may be processed in Canada or other countries where our service providers operate; protections will be contractually required to be comparable to those under PIPEDA/PIPA. 


14) Changes to This Policy

We may update this Policy. Material changes will be notified in-App or by email. The “Effective Date” above shows when this Policy took effect.

16) Governing Law & Dispute Resolution

This Policy and any dispute, claim, or proceeding relating to privacy or data protection is governed by the laws of Canada and the laws of the Province of British Columbia, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the provincial and federal courts located in British Columbia, Canada.


Our product is developed based on DCloud uni-app (5+ App/Wap2App). During application operation, it is necessary to collect your device's unique identification code (IMEI/android ID/DEVICE_ID/IDFA, SIM card IMSI information, OAID) to provide statistical analysis services. Performance and user experience will be improved through analysis of app startup data and exception/error logs, aiming to deliver better services to users.
